McCourt Divorce and Income Available for Support

The divorce proceedings pending between Frank and Jamie McCourt in Los Angeles Superior Court shed light on interesting legal issues for California Family Law practioners. Specifically, the most recent spousal support order raised eyebrows for most people who have managed to live on a bit less than the approximately $600,000.00  per month awarded to Jamie McCourt. Two things come immediately to mind. First, everything is relative. If your life style during marriage cost 100 times more than what most people spend, then the support awarded by the family court will probably be 100 times higher than what most people should expect. Second, the "income" that is available from which to pay support is not always easy to ascertain. In the McCourt's case, they agree to having "paid" their two adult sons a total of over $600,000.00  a year, but neither of the parents can describe what the sons did to earn those monies. The family court can look past what people "call " payments and add it back into the pot of money available for support.These legal issues are not uncommon...but the actual numbers can be mind boggling to many of us. This case is just at its preliminary stages so we can expect more revelations in coming months as property division issues, including ownership of the Dodgers, take the spot light.
